These terms are an agreement between you and Spiryted (“we”, “us”) governing your use of the game Featherfall (the “Game”). By downloading, installing or playing the Game you accept these terms. If you do not accept them, do not use the Game.
The Game is offered to players aged 16 or over. It is not directed to children. By using the Game you confirm that you meet this age requirement.
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and play the Game on devices you own or control, for your own non-commercial entertainment. This licence gives you no ownership of the Game.
The Game and everything in it — its source code, artwork, level designs, music, sound effects, name and branding — is owned by us and protected by copyright and other laws. All rights not expressly granted are reserved.
The Game includes the typefaces Fredoka and Nunito, used under the SIL Open Font License, and open-source software components under their respective licences. Those components remain the property of their authors and are governed by their own licence terms.
Stars, unlocked levels, birds and any other in-game item have no monetary value, cannot be exchanged for money or anything of value, and are not your property. Progress is stored only on your device: we cannot restore it, and it may be lost if you uninstall the Game, clear its data, or change device.
The Game is free and funded by advertising supplied by Google AdMob. Ads are selected and delivered by Google, not by us. We do not endorse advertised products and are not responsible for advertisers’ content, websites or business practices. Handling of data for advertising is described in our Privacy Policy.
We may update, change or discontinue the Game, or any part of it, at any time and without notice. We are not obliged to provide support, updates or continued availability.
This licence ends automatically if you breach these terms. You may end it at any time by uninstalling the Game. Sections 4, 5, 9, 10 and 11 survive termination.
THE GAME IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT PROGRESS WILL BE PRESERVED.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROGRESS, PROFITS OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE GAME. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE GAME WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE GAME (WHICH IS ZERO) OR USD 10.
Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain exclusions, so parts of sections 9 and 10 may not apply to you. If you are a consumer, you keep any mandatory statutory rights you have under the law of your country of residence.
These terms are governed by the laws of the Islamic Republic of Pakistan, without regard to its conflict-of-law rules, and the courts of Pakistan will have jurisdiction — except where the mandatory consumer protection law of your country of residence gives you the right to bring proceedings locally.
The Game is distributed through Google Play, and your use is also subject to the Google Play Terms of Service. Google is not a party to these terms and has no responsibility for the Game.
We may revise these terms. The revised version will be published at this address with an updated effective date, and continuing to play after that constitutes acceptance.
